Dustin C. Toney
Enrolled Agent (EA)

Founder of Fiduciary Tax & Accounting Services — focused exclusively on the tax side of estates, trusts, and fiduciary administration.

Background

Dustin's background is in public accounting, working with individual and fiduciary clients navigating the tax side of estates, trusts, and everything that comes with them. His practice centers on the returns and compliance obligations that arise when someone passes away, becomes incapacitated, or when a trust is being administered — work that sits at the intersection of tax law, fiduciary duty, and family dynamics.

FTAS exists to give people thrust into fiduciary roles — executors, trustees, family members holding the paperwork — the focused expertise generalist preparers often can't offer. Most clients come to FTAS because a life event created a tax obligation they didn't expect, and they need someone who handles this work every day, not once a year.

Areas of focus

  • Estate and trust income tax (Form 1041) — annual filings for estates and trusts, DNI calculations, K-1 preparation, and distribution planning to minimize the compressed trust tax brackets
  • Federal estate tax (Form 706) — estate tax returns, DSUE portability elections, and coordination with probate timelines
  • Gift tax (Form 709) — annual gift tax filings, lifetime exemption tracking, and gift splitting elections
  • Fiduciary accounting — UPIA-compliant principal and income accountings for court filings and beneficiary reporting
  • Individual returns — particularly for beneficiaries with K-1s, retirees with complex retirement income, and surviving spouses navigating the transition after a loss
  • Inherited assets and basis — stepped-up basis determinations, date-of-death valuations, and coordination between the estate return and beneficiary returns

Credential

Dustin is an Enrolled Agent (EA) — a federally licensed tax practitioner authorized by the U.S. Department of the Treasury to represent taxpayers before the IRS. The EA designation is the highest credential the IRS grants and requires passing a comprehensive three-part examination covering individual taxation, business taxation, and representation, ethics, and practice procedures. Enrolled Agents are authorized to represent any taxpayer on any tax matter before any IRS office — a scope of practice that extends nationwide and is not limited by state lines.

How FTAS works

FTAS operates as a focused, virtual practice — serving clients across the country from Birmingham, Alabama. Every engagement runs through a secure client portal with separate matter files for each estate or trust, clear scope and upfront fees, and year-round availability. Estates and trusts don't follow the standard tax calendar, and neither does FTAS.
